1. Payment Terms
1.1 The Client acknowledges and agrees that all funeral and cremation fees, charges, and disbursements (the Funeral Account) must be paid in full prior to the scheduled funeral or cremation service taking place.
1.2 The payment of funeral costs is not contingent upon the granting of probate, reimbursement from WorkCover, insurance claims, Centrelink payments, Superannuation funds, the Department of Veterans’ Affairs, or any other third-party or statutory payment.
1.3 The Client named in this Agreement remains personally responsible for all amounts payable, irrespective of any expectation of reimbursement from a third party.

2. Payment Due Date & Late Fees
2.1 Full payment of the Funeral Account is due and payable prior to the cremation being undertaken.
2.2 Any further recovery action undertaken will attract interest calculated at the statutory interest rate applicable in Queensland at the time of accrual.
2.3 Cremations Online shall have no obligation to proceed with the funeral or cremation service unless and until full payment has been received and cleared.

3. Cancellation or Rescheduling of Funeral or Cremation Services
3.1 Cremations Online reserves the right, in its sole discretion, to cancel, postpone, or reschedule a funeral or cremation service where full payment has not been received prior to the scheduled service time.
3.2 Cremations Online shall not be liable for any loss, damage, distress, inconvenience, or consequential loss arising from a cancellation, delay, or rescheduling caused by the Client’s failure to make timely payment.
3.3 Where the Client cancels the service, any reasonable costs incurred by Cremations Online up to the point of cancellation will remain payable by the Client.

4. Release of Cremated Remains and Documentation
4.1 Cremated remains and official documentation, including the Death Certificate, will not be released, delivered, or made available to the Client until the Funeral Account has been paid in full.
4.2 Cremations Online retains a lien over cremated remains and documentation until payment is received.

5. Debt Recovery & Collection Fees
5.1 Cremations Online reserves the right to refer unpaid accounts to the Marshal Freeman or any other licensed debt recovery agency.
5.2 Any reasonable recovery costs, legal fees (on a solicitor–client basis), and collection charges incurred in the process of recovering outstanding amounts will be added to the unpaid balance and remain the responsibility of the Client.

6. Price Estimates & Variations
6.1 Any funeral price estimate provided by Cremations Online is made in good faith based on the information available at the time of quotation.
6.2 Estimated pricing is not binding and may be subject to variation. The final amount payable will reflect the actual goods, services, government fees, permits, charges, or taxes incurred.
6.3 The Client agrees to pay any additional charges that arise due to changes requested by the Client or due to unforeseen circumstances beyond the control of Cremations Online.

7. Goods and Services Tax (GST)
7.1 All prices quoted include Goods and Services Tax (GST) where applicable under Australian law.

8. Authority to Act
8.1 By signing this Agreement, the Client authorises Cremations Online to act on their behalf in all matters necessary for the care, preparation, transportation, cremation, and arrangements regarding the deceased.
8.2 The Client warrants that they have the legal authority to engage Cremation Online and to give all necessary directions and approvals.

9. Indemnity for Freight of Ashes and Documentation
9.1 Where the Client elects to have cremated remains or official documentation transported by post or courier, Cremations Online will take reasonable care in packaging and dispatch.
9.2 Once cremated remains or documentation have been collected by the chosen postal or courier provider, Cremations Online accepts no responsibility for delay, loss, damage, or mis-delivery.
9.3 By selecting freight or postal delivery, the Client indemnifies and holds Cremations Online harmless from any claim, liability, damage, cost, or loss arising from the delay, loss, or damage of ashes or documentation once they are in the possession of the delivery provider.

Funeral Authorisation and Payment

I, the undersigned, acknowledge and declare that I have read, understood, and agree to be legally bound by this Funeral Service Agreement, including the Schedule of Estimated Charges and the Terms and Conditions contained herein.

I confirm and warrant that:

1. Authorisation of Arrangements
I authorise Cremations Online to make all necessary funeral and cremation arrangements as detailed in this Agreement and acknowledge that such arrangements will be carried out in reliance upon the information and instructions I have provided.

2. Acceptance of Fees, Charges, and Variations
I accept the estimated charges set out in the Schedule, and I acknowledge that the final amount payable may vary based on the actual goods, services, government fees, or lawful adjustments incurred. I agree to pay in full for all services provided and materials supplied in accordance with the Terms and Conditions.

3. Binding Payment Obligation
I understand and agree that all funeral and cremation fees must be paid in full prior to the scheduled service, and I accept full responsibility for payment of all amounts owing under this Agreement, regardless of any expectation of reimbursement from a third party.

4. Accuracy of Information Provided
I confirm that all information I have provided in relation to this Agreement is true, correct, and complete to the best of my knowledge, and I acknowledge that Cremations Online is entitled to rely on the accuracy of this information.

5. Authority and Capacity to Enter Agreement
I warrant that I have the lawful authority and capacity to enter into this Agreement and to provide directions regarding the care and cremation of the deceased.

By signing the forms, I acknowledge that I enter this Agreement voluntarily and with full understanding of its terms, obligations, and legal effect.
